Le département d'État a adopté aujourd'hui une nouvelle politique de restriction des visas en vertu de la section 212(a)(3)(C) de la loi sur l'immigration et la nationalité (INA). Cette politique vise les propriétaires, les cadres et les hauts fonctionnaires des compagnies de vols charters, de transport terrestre et maritime qui fournissent des services de transport destinés principalement aux personnes ayant l'intention de migrer de manière irrégulière vers les États-Unis. Cette nouvelle politique renforce et remplace la politique dénommée Nicaragua 3C sur les vols charters publiée en novembre 2023.
Cette politique cible les opérations de transport qui exploitent les migrants vulnérables et facilitent les migrations irrégulières dans le monde entier et vers les États-Unis. Les personnes qui viennent aux États-Unis sans base légale paient souvent des prix exorbitants et se mettent en danger, ainsi que les membres de leur famille qui les accompagnent, uniquement pour faire l'objet d'une procédure d'expulsion en vertu des lois américaines sur l'immigration.
Personne ne devrait profiter des migrants vulnérables - ni les passeurs, ni les entreprises privées, ni les fonctionnaires, ni les gouvernements. New Visa Restriction Policy for Transportation Operators Facilitating Irregular Migration to the United States
The State Department is today implementing a new visa restriction policy under Immigration and Nationality Act (INA) Section 212(a)(3)(C) that targets owners, executives, and senior officials of charter flight, ground, and maritime transportation companies providing transportation services designed for use primarily by persons intending to migrate irregularly to the United States. This new policy expands and supersedes the Nicaragua 3C policy on charter flights issued in November 2023.
The policy targets transportation operations that prey on vulnerable migrants and facilitate irregular migration around the world and to the United States. Those who come to the United States without a legal basis often pay extortion-level prices and put themselves and accompanying family members at risk, only to be placed into removal proceedings pursuant to U.S. immigration laws.
No one should profit from vulnerable migrants—not smugglers, private companies, public officials, or governments. We will continue engaging with governments and the private sector, both within and outside the region, to eliminate this exploitative practice.
